1. Welcome to HeyKidGo
These Terms & Conditions ("Terms") govern your access to and use of HeyKidGo (the "Service"), operated by HeyKidGo ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. The Service is intended for users 18 years or older who are responsible for planning travel for themselves or their families.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating an account, and to update that information as needed. We use Clerk to manage authentication and may rely on third-party identity providers such as Google or Apple if you choose to sign in with them.
3. Acceptable Use
You agree not to misuse the Service. Specifically, you will not: (a) attempt to reverse-engineer or scrape the Service; (b) use the Service to harass, harm, or mislead others; (c) upload content you do not have rights to; (d) use the Service to violate any applicable law; or (e) attempt to overload, disrupt, or interfere with the Service's infrastructure.
4. AI-Generated Content & Travel Information
HeyKidGo uses artificial intelligence to generate travel itineraries, recommendations, and suggestions. This information is provided for planning purposes only and is not a substitute for your own judgment. Hours, prices, availability, safety conditions, age suitability, and other details may be inaccurate, out of date, or incomplete. You are solely responsible for verifying information before relying on it, especially for anything safety-related (allergens, water depth, age limits, transit options). We make no warranty that any recommended location, business, or activity will be open, available, safe, or suitable for your family.
5. Bookings & Third-Party Services
HeyKidGo helps you plan trips but does not directly book flights, hotels, restaurants, or activities. Any booking, reservation, or purchase you make with a third party is governed by that third party's terms and policies. We are not responsible for the actions, omissions, refunds, or quality of any third-party provider.
6. Paid Plans & Refunds
HeyKidGo offers free and paid features. Paid features (including day-unlock purchases and subscriptions) are processed through Stripe. Prices are shown in US dollars unless otherwise indicated. Single-day unlocks and one-time purchases are non-refundable once the digital content has been delivered. Subscriptions renew automatically until cancelled; you can cancel at any time from your billing settings, and access continues until the end of the paid period.
7. User Content
Trip details, family-member profiles, comments, and other content you create or upload remain yours. By using the Service you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and adapt that content solely as needed to operate, secure, improve, and provide the Service to you and to people you choose to share it with.
8. Sharing & Collaboration
If you invite a co-parent, family member, or other collaborator to a trip, you represent that you have the authority to share that information with them. Anyone with a sharing or vote link you generate may view the relevant trip content; you are responsible for who you share these links with.
9. Intellectual Property
The Service, including the HeyKidGo name, logo, software, designs, and AI models, is owned by HeyKidGo and protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the Service in accordance with these Terms.
10. Termination
You may stop using the Service at any time and request deletion of your account by emailing support@heykidgo.com. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates legal, security, or operational risk for us or other users.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content.
12. Limitation of Liability
To the fullest extent permitted by law, HeyKidGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $50.
13. Indemnification
You agree to defend, indemnify and hold harmless HeyKidGo and its affiliates from and against any claims, liabilities, damages, losses and expenses arising out of your use of the Service, your content, or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising under these Terms.
